1. Introduction

Bison & Bird ("we," "us," or "our") provides services that incorporate Application Programming Interfaces (APIs) from Microsoft Copilot. By using our services, you ("the Customer") agree to comply with the following terms and conditions, which govern the use of these APIs and our associated services.

2. API Usage

Our services may integrate features powered by Microsoft Copilot, and by using these services, you acknowledge and agree to be bound by Microsoft’s API and service usage terms. It is your responsibility to ensure compliance with Microsoft’s policies.

3. Data Collection and Privacy

By using our services, some data may be processed through Microsoft Copilot APIs. Bison & Bird does not store or retain customer data processed via Microsoft’s API, but Microsoft may process and store such data as outlined in its privacy policy.

It is your responsibility to review these privacy terms and ensure compliance with applicable data protection laws.

4. Data Security and Confidentiality

While Bison & Bird takes measures to protect the confidentiality of your data, we cannot control how third-party providers such as Microsoft handle data. You should refer to Microsoft’s security documentation to understand their practices and ensure that they meet your security requirements:

By using our services, you agree that Bison & Bird is not responsible for any security breaches or data losses caused by Microsoft or other third-party providers.

5. Acceptable Use

You agree to use the services provided by Bison & Bird, including those powered by Microsoft Copilot, in accordance with all applicable laws and Microsoft’s Acceptable Use Policy.

Prohibited uses include, but are not limited to:

• Creating content that violates any law or infringes on the rights of others.

• Using the services to distribute harmful or offensive content.

Failure to comply with these acceptable use guidelines may result in suspension or termination of services.

6. Liability

Bison & Bird provides no warranties regarding the accuracy, reliability, or availability of services powered by Microsoft Copilot APIs. We are not responsible for any direct or indirect damages resulting from your use of these services, including but not limited to:

• Any errors or downtime related to Microsoft Copilot’s services.

• Data loss or exposure resulting from Microsoft’s API usage.

Bison & Bird will not be held liable for any issues arising from third-party services, including Microsoft.

7. Intellectual Property

Any content generated through Microsoft Copilot’s services is subject to Microsoft’s intellectual property policies. You retain ownership of your data, but Microsoft may use this data for the purposes outlined in their terms and policies.

8. Updates and Changes to Terms

Bison & Bird reserves the right to update these terms and conditions at any time. Any changes will be communicated to you, and your continued use of the services constitutes acceptance of the updated terms.

9. Governing Law

These terms and conditions are governed by the laws of Alberta, Canada. Any disputes related to the use of our services will be resolved in the courts of Alberta.
